Canada Releases 25 Categories of Foreign Nationals Who May Work Without a Work Permit

The Canadian government has published guidance outlining 25 categories of foreign nationals who may be eligible to work in Canada without obtaining a traditional work permit, providing exemptions for certain workers, students, professionals and other temporary visitors.

The guidance from Immigration, Refugees and Citizenship Canada (IRCC) covers specific circumstances in which foreign nationals can perform work activities without first securing a work permit. However, eligibility is not automatic, and individuals must meet the requirements that apply to their particular category.

The 25 categories span several areas, including academics and skilled professionals, business visitors, military personnel, athletes and sports professionals, students and religious leaders.

Among the categories identified are examiners and evaluators, public speakers, short-term researchers and certain short-term high-skilled workers. Some students may also qualify for work without a separate work permit under specific conditions.

The rules also include exemptions for certain international students. These include eligible healthcare students undertaking short-term training, recent graduates from Canadian designated learning institutions who have already applied for a work permit, and eligible full-time study permit holders working on or off campus.

Religious leaders are another category listed under Canada’s work-permit exemptions. The exemptions are designed for specific situations and should not be interpreted as a general authorization for foreign nationals to work in Canada without immigration approval.

The Canadian government stresses that being included in an exempt category does not automatically guarantee entry into Canada or permission to work. Foreign nationals may still need other immigration documents, including a visitor visa or an electronic travel authorization, depending on their nationality and circumstances.

The distinction is important because Canada’s general immigration system requires many foreign nationals to obtain a work permit before they can legally work in the country. IRCC provides separate pathways for people seeking temporary employment, including employer-specific and open work permits.

The exemptions are intended to cover narrowly defined activities where Canadian immigration rules recognize that a work permit may not be necessary. Foreign nationals considering employment or work-related activities in Canada should therefore confirm that their circumstances meet the applicable exemption before beginning work.
