The Court of Appeal, sitting in Abuja upheld Martin Amaewhule as the duly recognized Speaker of the Rivers State House of Assembly, dismissing the appeal filed by Governor Siminalayi Fubara.

A three-member panel of the appellate court delivered a unanimous judgment, declaring the governor’s appeal lacked merit. The court firmly upheld the January 22 ruling of the Federal High Court, which was delivered by Justice James Omotosho. The lower court had nullified the 2024 Rivers State budget, tagged “Budget of Renewed Hope,” amounting to N800 million, citing its non-presentation before the members of the State Assembly as a breach of legal procedures.

In its ruling, the Court of Appeal admonished Governor Fubara for disregarding the rule of law, emphasizing that his actions in presenting the 2024 Rivers State Appropriation Bill to only four out of the 31 Assembly members constituted a significant violation of the 1999 Constitution, as amended.

Speaking to journalists after the judgment, the Speaker of the Rivers State House of Assembly, Rt. Hon. Martin Amaewhule, hailed the decision as a “well-considered judgment” that affirmed the principles of justice and democratic governance.
