Minnesota AG Files Preemptive Lawsuit Against Trump Over Proposed Transgender Sports Ban
Minnesota Attorney General Keith Ellison has filed a preemptive lawsuit against former President Donald Trump in response to his proposed federal ban on transgender athletes participating in school sports. The legal action, filed in anticipation of a potential Trump return to the White House, seeks to block any future enforcement of policies that Ellison argues would violate constitutional rights and federal anti-discrimination laws.
The lawsuit, submitted to a federal court this week, argues that Trump’s proposal — repeatedly mentioned on the campaign trail — poses an imminent threat to civil liberties and equal protection guarantees for transgender youth. Although the ban is not yet in effect, Ellison said the preemptive legal action is necessary due to the serious implications of Trump’s public policy pledges.
“We are taking a stand now because the rights of transgender students should not be used as political talking points,” Ellison said in a press statement. “Minnesota is committed to protecting all students, and we will not allow discriminatory policies to strip young people of their dignity, identity, and right to participate fully in school life.”
Trump has repeatedly stated that, if elected in 2024, he would seek to implement a nationwide ban on transgender athletes competing in sports that align with their gender identity, particularly in K-12 and college athletics. His position has drawn widespread support from conservative circles but fierce backlash from LGBTQ+ rights advocates, educators, and medical professionals who view such policies as harmful and unconstitutional.
Ellison’s lawsuit preemptively challenges the legality of any federal directive targeting transgender participation in sports, citing violations of the Equal Protection Clause, Title IX of the Education Amendments Act, and the First and Fourteenth Amendments of the U.S. Constitution.
Civil rights groups have praised the move, calling it a bold and necessary step to safeguard LGBTQ+ youth in the current political climate.
“This lawsuit sends a strong message that hate-driven policies have no place in our schools or our legal system,” said a spokesperson for the Human Rights Campaign. “It also sets a precedent for other states to resist federally imposed discrimination.”
Legal experts suggest that while the case is unusual in its timing — targeting a policy that has yet to be enacted — it could set the stage for future constitutional battles over the rights of transgender individuals in education and athletics.
The Trump campaign has not yet responded to the lawsuit. However, his team has previously defended the proposed ban as a measure to ensure “fairness in women’s sports” and protect what they describe as “biological integrity” in competition.
As debates over transgender rights and school sports policies continue to polarize communities and lawmakers nationwide, this lawsuit could represent a landmark moment in the legal struggle over how far states and future federal administrations can go in regulating gender identity in education.
