A new study from Women’s College Hospital in Toronto has uncovered how private, for-profit clinics in Canada are quietly converting patient medical records into commercial assets and selling them to pharmaceutical companies. Published in JAMA Network Open, the research highlights two models used to monetize health data: one where clinics sell de-identified data to third-party brokers, and another where clinics are subsidiaries of the data-collecting firms themselves—allowing direct access.

The study, based on 19 interviews, raises concerns over the lack of patient consent and transparency. Researchers found no involvement from patients in data-sharing decisions, with lead author Dr. Sheryl Spithoff calling for immediate oversight. Legal experts say current privacy laws—written in a pre-digital age—are outdated and ill-equipped to handle the risks of data re-identification enabled by modern AI and big data.

As electronic health records become more widespread and managed by tech-linked third parties, experts argue the legislative framework must evolve to prioritize data security and patient control. The Office of the Ontario Privacy Commissioner acknowledged the need for stricter rules around the use and resale of health data, while urging stronger risk assessments when handling personal information.

The findings reveal a troubling convergence of health care and tech-driven commercialization, where sensitive medical data is mined and monetized—often without public awareness. Patients are urged to review clinic privacy policies and pressure lawmakers to update protections in light of this growing digital health ecosystem.
