NIGERIA: FCCPC Responds to WhatsApp’s Exit Threat, Emphasizes Commitment to Consumer Protection

The Federal Competition and Consumer Protection Commission (FCCPC) has dismissed WhatsApp’s threat to exit Nigeria following the Commission’s recent order, stating that such actions will not affect the judicial process. In a statement released by FCCPC’s Director of Corporate Affairs, Ondaje Ijagwu, the Commission reaffirmed that Meta Parties must comply with Nigerian laws.

Ijagwu described WhatsApp’s exit threat as a strategic attempt to generate negative public reaction and exert pressure on the FCCPC to reverse its decision. He stressed that the Competition and Consumer Protection Tribunal’s ruling, which confirmed FCCPC’s final order, mandates Meta Parties to stop exploiting Nigerian consumers and align their practices with both Nigerian regulations and international standards.

The Tribunal had imposed a $220 million fine on Meta Platforms Incorporated and WhatsApp LLC for multiple violations of Nigerian law, including the mishandling of user data and discrimination against Nigerian users. The Tribunal also awarded $35,000 to the FCCPC as the cost of investigation.

Meta’s violations include transferring and sharing Nigerian user data without consent, forcing unfair privacy policies, and abusing its dominant market position. Ijagwu pointed out that Meta has faced similar penalties globally, including in Texas, India, South Korea, France, and Australia, without resorting to exit threats.

The FCCPC emphasized its commitment to ensuring consumer protection, data privacy, and a fair digital market in Nigeria, ensuring Meta adheres to legal requirements for the benefit of Nigerian consumers.
