A judge has declared a mistrial in the Lindsay Clancy murder trial after jurors failed to reach a unanimous verdict on whether the Massachusetts mother was criminally responsible for killing her three young children.
The mistrial was declared Friday after the jury spent seven days deliberating without reaching a decision. The development leaves the high-profile case unresolved and means prosecutors could potentially seek a new trial.
Clancy, a 36-year-old former labor and delivery nurse, was charged with killing her children — 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan — at the family’s home in Duxbury, Massachusetts, in January 2023.
Clancy has never disputed that she killed the children. Her defense, however, argued that she was suffering from postpartum psychosis, a rare and severe mental health disorder that can occur after childbirth, and therefore should not be held criminally responsible for her actions.
Prosecutors acknowledged that Clancy had experienced significant mental health problems but argued that she understood what she was doing and was capable of controlling her actions. They presented evidence suggesting that the killings were deliberate.
The case became a closely watched legal battle over criminal responsibility and mental illness. Jurors heard testimony from medical and psychological experts who offered sharply different assessments of Clancy’s mental state around the time of the killings.
The jury’s inability to agree came after nearly 40 hours of deliberations. The mistrial means there is currently no final verdict in the case. Prosecutors must now determine whether to retry Clancy, dismiss the charges or pursue another resolution, including a possible plea agreement. Plymouth County District Attorney Timothy Cruz said there would be no immediate decision on whether to hold another trial.
The case has attracted intense national attention, particularly because of its focus on maternal mental health and postpartum psychiatric disorders. Clancy’s family has portrayed her as a loving mother who recognized that her mental health was deteriorating and sought professional help before the killings.
Clancy remains hospitalized in a psychiatric facility while the legal proceedings continue. A hearing to determine the next steps in the case has been scheduled for September 29.
